Welcome to Palm Springs style living, with lots of privacy!
Experience a simple understated elegance in this 2 bedroom 2 bath home, which creates a relaxed, comfortable, easy living feel. Throughout the home, there are lots of large windows and sliders, which blur the lines between indoor and outdoor living in true Palm Springs-style. The open layout is perfect for spending time with friends and family.

The newly landscaped grounds are manicured with the same style as the interior of this quality boutique home. Unobstructed southwest facing mountain views and contemporary landscaping make for the perfect place for martinis while enjoying our warm evening nights (sunsets are amazing) under the stars. Our pebble-tech salt-water pool and elevated built-in waterfall spa is where you will want to spend most of your time. The pool can be heated at an additional charge. The spa is included in the rental. Everything you need outside is here including a sunning area with 4 chaise lounge chairs, a sitting area with comfortable couches and a covered dining area
and gas grill.

The spacious living room includes a 55" HDTV, comfortable leather sectional with pull out bed and beautiful open views of the pool-scape.

The spacious kitchen is light and bright and features Bosch stainless steel appliances, quartz counter tops and plenty of cabinet space. The kitchen looks out over the outside dining and siting area and is connected to a formal inside dining area.

The master ensuite has sliders leading out to the pool and has an amazing king bed you will not want to get out of. The 2nd bedroom equipped with a queen bed is as equally comfortable!

Both full baths with large walk in showers, have been recently renovated with a modern sleek appeal.

We invite you to bring along your four legged family members. The home is equipped for pets. The house is thoroughly “pet cleaned” once the pet guests depart. Pet fee is $275. Just let us know you will be bringing your pet.

Location, location, location! The house is about 10 minutes from downtown Palm Springs where there are endless things to do. Also 10 minutes from Rancho Mirage and Palm Desert where there is great shopping, movies and restaurants.

The community fee you will see at check out is the city tax we are required to collect.

Airbnb Vacation Rental Agreement
This Vacation Rental Agreement (this “Agreement”) is entered into as of the __ day of
______, 2018 by and between ___________(“Owner”) and ______________ the individual identified as Renter on the signature page of this Agreement
Owner is the owner of that certain property commonly known as Ashley House Cathedral City, Ca. 92234 (the “Property”).
Owner rents the Property out for short-term vacation rentals and Owner desires to rent the Property to Renter and Renter desires to rent the Property from Owner as a short- term vacation rental pursuant to the terms of this Agreement.

Based upon the mutual promises and covenants hereinafter set forth, Owner and Renter hereby agree as follows:

1. Term. Renter shall be permitted to occupy the Property from 3:00 pm on _______________, 2018 until 10:00 am on ___________, 2018 (the “Rental Period

2. Leased Property /Rules and Regulations.
a. Owner agrees to lease to Renter the Property for use as a vacation rental only. The Property may not be used for the purpose of carrying on any business, profession or trade of any kind or for the purpose other than as a private single-family vacation rental.
b. The number of individuals in the Property (individuals sleeping in the home or guests invited to the Property) at any time may not exceed ___ without the prior written consent by Owner, which may be withheld in its sole discretion. No parties with invited guests shall be held in the Property. Failure to comply with these regulations will result in a fine of $2,000.

c. Renter acknowledges and agrees that the Property has been designated as a smoke-free living environment and that Renter and members of Renter’s household or invited guests will not smoke anywhere in or on the Property. Failure to comply with these regulations will result in a fine of $1,000.

e. Renter acknowledges and agrees that it is the responsibility of Renter to supervise children at all times.

f. Renter will promptly notify Owner of any damage, or of any situation that may significantly interfere with the normal use of the Property or to any furnishings supplied by Owner. The Airbnb Rental damage Protection deposit will cover any damage up to $3,000.00. Renter agrees that any damage in excess of the above amount will be charged to Renter’s credit card.

g. Renter will not make (or allow to be made) any noise or nuisance that disturbs the comfort or convenience of the Property’s neighbors. Renter acknowledges and agrees that the City of Cathedral City has strict noise restrictions for which they issue fines. The city of Cathedral City has a curfew and does not allow any outside noise after 10:00 PM and does not permit the use of any amplified sound outside the house or at a volume audible outside the house at any time.. Renter agrees that for any reason the city issues a citation to the homeowner for a noise complaint caused by renters renter is agreeing for home owner to charge renters credit card for that fine. If a citation is written directly to the renter, renter agrees to pay the fine to the city. If homeowner needs to hire an attorney to collect the citation fine, renter is agreeing to cover all homeowners attorney fees in regards to this matter.

h. Garbage Collection: Two (2) 32 gallon trash containers and two (2) 32 gallon recycle containers are provided. If you have garbage in excess of this you will need to take it to the Palm Springs dump or recycle station (directions and location are provided in the house manual). If there is garbage left in excess of the four (4) containers you will be charged a $50.00 fee for its removal. This is in consideration of the arrival of the next rental guests.

i. Renter agrees to keep the Property reasonably clean and in condition substantially similar to that at the commencement of the Rental Period.

j. Renter will not engage in any illegal trade or activity on or about the Property and will not possess drugs on or about the Property.

k. The City of Cathedral City requires that Renter is 21 years of age or older. A copy of the primary Renter’s Driver's License or Passport must be emailed to Owner so they can keep it on file. Renter hereby acknowledges and represents that Renter is at least 30 years of age as of the date of this Agreement.

l. Renter acknowledges and agrees to pay the following fines if any of the following items are lost or removed from the Property: (i) lost house keys ($250 fine); (ii) and lost TV remotes ($500 fine).

m. Renter further agrees that Renter, and any guests or invitees of Renter, shall at all times comply with all federal, state, county and local laws, rules, and regulations, including, but not limited to, the City of Rancho Mirage Vacation Rental Ordinance, while at the Property.

3. Entry to the Property. A lock box has been placed outside the property with the keys for the house. The location, along with complete entry instructions, will be sent to Renter separately once this Rental Agreement has been fully executed, returned, and accepted by Owner. Failure to return this key to the lock box upon check-out will result in a $1000 fine.

4. Utilities. Utilities and the heating of the hot tub are included in the rental of the Property, with the exception of the heating of the Pool. With advance written notification, the pool can be heated upon the request of Renter for an additional $50.00 per day (Owner’s pool service will turn on the heat during their weekly rounds). Once Renter occupies the home and decides they would like the pool to be heated, the pool can be heated upon the written request of Renter for an additional one time charge of $20.00 (what Owner pays the pool company for a special trip out to turn the heat on) plus $50.00 per day. Tampering with the Pool equipment at any time will result in a $1000 fine.

5. Security Cameras. Security Cameras. Renter acknowledges and understands that Owner has security cameras monitoring the exterior of the Property. Tampering with security system/cameras will result in a $1000 fine.

6. Cleaning Fee and Damage Deposit. The $175 Cleaning fee paid by Renter is for a 6 hour period for the cleaning of the house and outside pool area. Any extra hours needed to clean the house because of an excess amount of towels used or the condition the Renter has left the house will be either charged at a rate of $40 per hour. or taken out of the Airbnb $3000 damage deposit. The Airbnb Damage deposit covers most items unintentionally damaged but by booking this reservation renter is agreeing to be responsible for the cost of all items damaged not covered or approved by Airbnb.

7. No Daily Maid Service. Bed linens, bath and beach towels are included at the Property for use during the Rental Period. Daily maid service is not included in the Rental Fee, but is available for an additional fee upon written request to Owner.

8. Pool and Hot Tub. Renter acknowledges and agrees that no lifeguard is provided for the pool and hot tub at the Property. Renter agrees to supervise any children, guests, or invitees around the pool and hot tub at all times and Renter is solely responsible for their safety. Renter hereby assumes any and all risk of injury and liability arising from Renter’s (and any of Renter’s guests or invitees) use of the pool or hot tub. Use of the pool and hot tub is at Renter’s and any other person’s own risk.

9. Fireplaces. Indoor and outdoor fireplaces are GAS ONLY. Use of wood, paper, or any other materials in the fireplaces is prohibited and will cause severe damage and could result in fire or permanent injury. Failure to comply with this clause will result in a $500 fine.

a. The vacation rental payment and the $3000 damage deposit for the Rental Period for the Property is paid through Airbnb as quoted on their website. Airbnb does not actually charge the $3000. Damage deposit unless a claim is filed upon your departure.

11. Cancellation.
a. A written notice (email to Owner) is required to cancel your reservation.
12.FalsifiedReservations. Any reservation obtained under false pretense will be subject to forfeiture of any advance Rental Fee paid to Owner and Renter shall not be permitted to check-in to the Property.

13. Check-Out.
a. Prior to checking out of the Property, Renter agrees to put a load of towels into the washing machine and start the load (aiding the efficiency of the cleaning crew.).
b. Renter agrees to load and start the dishwasher before departing the Property.
c. On the day of check-out Renter agrees to take the garbage from the kitchen garbage can to the outside garbage receptacles.

14. Care and Use of Property. At the end of the Rental Period, Renter agrees to surrender the Property in as good a state and condition as the Property was delivered at the commencement of the Rental Period. Renter agrees to provide Owner reasonable access to the Property for purposes of emergency, repair, or inspection at any time during the Rental Period. Owner shall provide Renter notice of any service appointment scheduled during the Rental Period.

15.Hold Harmless. Renter here by releases and waives, and agrees to indemnify, defend and hold Owner and all of its respective members, managing members, employees, agents, affiliates, representatives and contractors (collectively, “Owner’s Parties”) harmless from, any and all claims, actions, demands, liabilities, damages, losses, costs, and expenses, including, without limitation, reasonable attorneys’ fees, (collectively, “Claims”) against Owner or Owner’s Parties arising from, in connection with or associated with any damage, injury, loss or harm to (i) the Property; (ii) Renter or Renter’s family; (iii) any occupant, guest, or invitee at the Property; or (iv) any property on the Property (including Renter’s personal property in or about the Property, including cars and the contents thereof) from any cause whatsoever during the Rental Period or arising out of or in connection with Renter’s occupancy of the Property.
16. Assignment and Subletting. Renter shall not assign this Agreement or sublet any portion of the Property without the prior written consent of Owner, which may be granted or withheld in Owner’s sole and absolute discretion.
17. Amendments. Amendments to this Agreement shall not be binding on either party unless mutually agreed to in writing by the parties.

18. Arbitration. Any controversy or claim arising out of or relating to this Agreement, or any alleged breach thereof, shall be settled by binding arbitration and judgment upon the award rendered by the arbitration shall be final and may be entered in any court having jurisdiction. (Notwithstanding the foregoing, nothing in this Agreement shall be interpreted to bar any party hereto from seeking injunctive relief in any court with respect to any controversy or claim arising out of or relating to this Agreement.) The arbitration shall be conducted in Riverside County, California by an arbitrator appointed by, and subject to the rules of, JAMS/Endispute or by a similar arbitration service if the parties mutually agree. In no event shall the demand for arbitration be made after the date when institution of legal or equitable proceedings based on such claim, dispute or other matter in questions would be barred by the applicable statute of limitations. This Agreement to arbitrate shall be specifically enforceable under the prevailing arbitration law. All of the provisions of §1283.05 of the California Code of Civil Procedure are hereby expressly made applicable to such arbitration.

19. Attorneys’ Fees, Costs. In the event of any litigation, arbitration or other proceeding or other dispute (other than mediation) arising as a result of this Agreement, the prevailing party shall be entitled, in addition to any other damages assessed, to its reasonable attorneys’ fees and all other costs and expenses incurred in connection with settling or resolving such dispute. The attorneys’ fees which the prevailing party shall be entitled to recover shall include any fees for prosecuting or defending any appeal and supplemental proceedings until the final judgment is satisfied in full, and for any post- judgment proceedings to collect or enforce the judgment. Subject to the provisions of local law, the prevailing party shall recover all such fees, costs or disbursements as costs assessable by the court or arbiter in the action or proceeding itself without the necessity for a cross-action by the prevailing party.

20. Time of Essence. Time shall be of the essence for each and every provision of this Agreement of which time is an element.

21. Counterparts. This Agreement may be executed by the parties hereto in any number of counterparts, each of which when so executed and delivered shall be deemed to be an original and all of which taken together shall constitute one and the same instrument, respectively. Executed copies of the signature pages of this Agreement sent by facsimile or transmitted electronically in PDF format shall be treated as originals, fully binding and with full legal force and effect, and the parties waive any rights they may have to object to such treatment.

22. Termination by Owner. In the event Owner decides to sell the Property, Owner may, in Owner’s sole discretion, terminate this Agreement effective immediately upon written notice to Renter. Upon such termination, Owner shall refund 100% of all monies paid to Renter.

23.Currency. All monetary amounts state do referred to in this Lease are based on the United States dollar.

24.WrittenExceptions. Any exceptions to the above mentioned policies must be approved in writing by Owner.

25.GoverningLaw. Any legal proceedings resulting from this Lease will be governed by the laws of the State of California without regard to the jurisdiction in which any action or special proceeding may be instituted.
